The challenge

The client was selling well on Amazon when copycats followed. When the client appealed to the platform, the other seller countered with a local trademark acceptance notice and filed an infringement complaint against the client instead — the listing was taken down twice. The client had only registered the mark in China and held no rights overseas, so the appeal had almost no chance of succeeding.

What we did

First, clearance: we ran similarity searches across 26 countries and flagged high-risk classes and already-claimed graphic elements, so the client would not pay for applications likely to be refused. Second, route selection: core classes went through the Madrid System, covering most member states with a single filing at lower cost and easier management. Key markets — the United States, Indonesia and Japan — were filed as national applications instead, because these offices scrutinise use evidence and examination practice more strictly, and national filings gave better control over timing. Third, evidence packs: we compiled sales records, advertising spend and packaging photos into proof-of-use files, ready for any opposition.

The result

The first certificates arrived within six months (United States, Japan, Indonesia). All five copycat complaints were upheld, and sales returned to their previous level once the listings were restored. With the marks in place, Brand Registry and A+ content were approved as well, unlocking the operating tools that followed.
